Terms of Service

These Terms of Service ("Terms") govern your use of picniq.net, open.picniq.net, and related services operated by picniq ApS ("picniq", "we", "us", or "our").

By accessing or using our services, you agree to be bound by these Terms.

1. What picniq is

picniq is a journey reporting and passenger rights information service.

When you purchase a Journey Report, you engage picniq to analyse a specific flight booking and associated travel itinerary. Our service combines flight monitoring, operational data, disruption analysis, publicly available information sources, and passenger-rights research to provide a report relating to your journey.

A Journey Report may include:

  • Scheduled and actual departure and arrival times.
  • Delay, cancellation, diversion, missed connection, and disruption analysis.
  • Flight route and itinerary assessment.
  • Weather and operational conditions relevant to the journey.
  • Airport-wide disruption information.
  • Publicly available airline communications.
  • Publicly available news and social media signals relevant to the disruption.
  • Identification of passenger-rights frameworks that may potentially apply to the journey.
  • Guidance on how a passenger may submit a request or claim directly to an airline.

picniq is not a law firm and does not provide legal advice, legal representation, claims management services, debt collection services, or litigation services.

2. The service we provide

The service purchased by the customer is the preparation and delivery of a Journey Report for a specific booking.

Depending on the product selected, the service may include:

  • Flight monitoring before, during, and after travel.
  • Collection and analysis of flight and operational data.
  • Assessment of potentially applicable passenger-rights frameworks and regulations.
  • Preparation of a Journey Report summarising relevant findings.
  • Preparation of template correspondence that may assist you in contacting an airline.
  • Information regarding relevant national enforcement bodies (NEBs), alternative dispute resolution (ADR) bodies, or similar organisations.

Any template correspondence or guidance is provided solely for informational purposes. Any request, complaint, or claim is submitted by you, in your own name, and under your own responsibility.

3. Passenger rights information

The passenger-rights information provided through our services is intended to help customers better understand possible rights and remedies that may be available following a travel disruption.

References to regulations, conventions, airline conditions of carriage, compensation schemes, reimbursement rights, or consumer protections are informational only.

The identification of a potentially applicable passenger-rights framework does not guarantee eligibility for compensation, reimbursement, assistance, refunds, or any other remedy.

Final determinations regarding eligibility remain the responsibility of airlines, regulators, dispute-resolution bodies, courts, or other competent authorities.

4. What we do not guarantee

We make reasonable efforts to provide accurate and useful Journey Reports, but we cannot guarantee any specific outcome. In particular:

  • We do not guarantee that compensation, reimbursement, refunds, vouchers, or other remedies will be available.
  • We do not guarantee that an airline will accept or respond to any request submitted by you.
  • We do not guarantee the success of any claim or complaint.
  • We do not guarantee that a particular passenger-rights framework applies to your circumstances.
  • We do not guarantee that information supplied by third-party data providers is complete, accurate, or available at all times.

Journey Reports are based on information available to us at the time of analysis and may differ from information subsequently provided by airlines, airports, regulators, or other parties.

5. Data sources and third-party information

picniq relies on a range of third-party data providers and publicly available information sources. These may include:

  • Flight tracking providers.
  • Aviation data providers.
  • Weather services.
  • Airport operational information.
  • Public news sources.
  • Public social media content.
  • Airline and airport communications.

We do not control these sources and cannot guarantee their accuracy, completeness, availability, or continued operation. Any disruption analysis or passenger-rights assessment generated by picniq is based in part on information supplied by these third parties.

6. Your obligations

You agree to:

  • Provide accurate and complete booking information.
  • Ensure you have authority to provide information relating to the booking.
  • Use the service only for lawful purposes.
  • Not submit fraudulent, misleading, or dishonest information.
  • Not attempt to interfere with, reverse engineer, or circumvent our systems.
  • Not access information relating to other passengers without authorisation.

You confirm that you are at least 18 years of age (or the age of majority in your jurisdiction) and have the legal capacity to enter into these Terms.

You remain solely responsible for any communication, request, complaint, or claim submitted to an airline or other organisation.

7. Pricing, right of withdrawal and refunds

The B2B service is provided to travel partners and other commercial customers under separate agreements.

The B2C service is available through picniq.net and is offered at the price displayed at the time of purchase.

Unless otherwise stated, payment relates solely to the preparation, monitoring, analysis, and delivery of a Journey Report.

Right of withdrawal (consumers). If you are a consumer in the EU/EEA, you normally have a 14-day right to withdraw from a distance contract for digital services. Because a Journey Report involves immediate processing and data collection, we begin performance promptly after purchase. By completing your purchase and confirming that you wish us to begin immediately, you (a) expressly request that we commence the service before the end of the withdrawal period, and (b) acknowledge that you will lose your right of withdrawal once the service has been fully performed.

Subject to the above, because the service begins shortly after a booking is submitted and involves immediate processing and data collection, refunds are generally not available once processing has commenced.

Nothing in these Terms affects any mandatory consumer rights that cannot be excluded under applicable law. We will promptly correct genuine billing or payment errors.

8. Privacy and data protection

picniq processes personal data — including your booking and itinerary information — in order to provide the service. Our processing is described in our Privacy Policy, which forms part of these Terms.

Where the service is provided to you through a travel partner or online travel agency (OTA), the respective roles of picniq and that partner in relation to your personal data are set out in the Privacy Policy.

9. Intellectual property

All content, software, reports, designs, trademarks, databases, and materials provided through picniq remain the property of picniq ApS or its licensors.

You may use a Journey Report for your personal, non-commercial use in connection with the relevant booking. You may not reproduce, resell, distribute, publish, or commercially exploit our reports or services without our prior written consent.

10. Limitation of liability

To the fullest extent permitted by law, picniq shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from or relating to your use of the service.

To the fullest extent permitted by law, picniq's total liability arising out of or relating to the service shall not exceed the greater of:

  • the amount paid by you to picniq during the twelve (12) months preceding the claim; or
  • EUR 50.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, for fraud, or any mandatory liability owed to you as a consumer.

11. Availability of the service

We may modify, suspend, or discontinue parts of the service at any time. We do not guarantee uninterrupted availability of the service and may perform maintenance, updates, or operational changes without notice.

12. Governing law and disputes

These Terms are governed by and construed in accordance with the laws of Denmark.

If you are a consumer, you continue to benefit from any mandatory provisions of the law of your country of residence that cannot be derogated from by agreement, and nothing in these Terms deprives you of that protection.

Any dispute arising out of or relating to these Terms or the use of the service shall be subject to the jurisdiction of the courts of Copenhagen, Denmark, save that, where you are a consumer, proceedings may also be brought in the courts of your country of domicile, and you may be sued only in those courts, to the extent required by applicable mandatory law.

13. General

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions remain in full force and effect.

These Terms, together with any product description and the Privacy Policy, constitute the entire agreement between you and picniq regarding the service.

We may assign or transfer these Terms to an affiliate or in connection with a merger, acquisition, or reorganisation; your rights as a consumer are not affected by any such assignment.

We are not liable for any failure or delay in performance caused by circumstances beyond our reasonable control.

No failure to enforce any provision constitutes a waiver of it.

14. Changes to these Terms

We may update these Terms from time to time. For material changes, we will provide reasonable notice before the updated Terms take effect. Continued use of the service after the effective date of the updated Terms constitutes acceptance of the revised Terms.
